General terms and conditions heyjob

1. Definitions
- heyjob: heyjob B.V., Chamber of Commerce (KvK) number 98190113, registered in the Netherlands.
- Customer: the legal entity or natural person that subscribes to the heyjob platform.
- Platform: the SaaS service available via heyjob.nl, including all modules, apps and integrations.
- User: any person granted access to the Platform by the Customer.
- Guest: a person whose data is processed by the Customer via the Platform (e.g. restaurant guests).
2. Scope
These general terms apply to all use of the Platform and to every agreement between heyjob and the Customer. The Customer’s deviating terms are expressly rejected unless agreed otherwise in writing.
3. Services
heyjob provides an all-in-one restaurant management platform, including modules for reservations, team planning, checklists, reviews, marketing and compliance, among others. Exact functionality depends on the selected subscription and any add-ons.
heyjob targets 99.5% annual availability, excluding planned maintenance. Planned maintenance is announced at least 24 hours in advance.
4. Subscription and pricing
- The base subscription costs €59 per month per location unless otherwise agreed.
- Add-ons (such as AI phone, reviews module) are billed separately.
- Prices exclude VAT.
- heyjob may adjust prices annually with at least 30 days’ notice. If prices increase, the Customer may terminate the subscription effective on the date the increase takes effect.
5. Trial period
heyjob offers a 14-day trial with access to the full platform. After the trial, the subscription ends automatically unless the Customer actively purchases a paid subscription. No charges apply during the trial.
6. Payment
Invoicing is monthly in advance. Payment is due within 14 days of the invoice date. If payment is late, heyjob may suspend access to the Platform after a reminder and a reasonable period.
7. Data and privacy
The Customer remains the owner of all data processed via the Platform. heyjob processes personal data in accordance with the GDPR and the privacy policy at heyjob.nl/privacy.
After termination, the Customer may request a full data export within 30 days. After that period, data will be deleted.
8. Intellectual property
All intellectual property rights in the Platform, software, documentation and related materials belong to heyjob. The Customer receives a non-exclusive, non-transferable right to use the Platform for the subscription term.
9. Liability
heyjob’s liability is limited to the amount the Customer paid to heyjob in the 12 months before the event giving rise to the claim. heyjob is not liable for indirect damage, consequential loss, lost profit or lost revenue.
heyjob is not liable for damage resulting from incorrect or incomplete data entered by the Customer or its Guests.
10. Availability and maintenance
heyjob may temporarily take the Platform offline for maintenance, updates or improvements. heyjob aims to do this outside office hours and to notify the Customer in advance. heyjob is not liable for damage due to temporary unavailability.
11. Termination
- The subscription can be cancelled on a monthly basis.
- Cancellation must be done via the Platform or by email to job@heyjob.nl.
- After cancellation, the subscription remains active until the end of the current billing period.
- There are no cancellation fees or minimum contract terms (after any trial period).
12. Changes
heyjob may amend these terms. Changes will be communicated by email to the Customer at least 30 days in advance. For material changes, the Customer may terminate the subscription.
13. Force majeure
heyjob is not required to perform any obligation if prevented by force majeure, including failures at hosting or internet providers, DDoS attacks, and government measures.
14. Governing law and disputes
These terms are governed by Dutch law. Disputes are submitted to the competent court in the district where heyjob B.V. is established.
